Terms and Conditions of Use and Sale

These terms govern use of Loja do Ouro and purchases made at www.lojadoouro.pt.

Read before purchasing. These terms do not restrict mandatory consumer rights. Product-page and checkout information forms part of the pre-contractual information.
01Company, contacts and scope+

Pérola do Tempo, S.A., NIPC 509 264 140, legal form Sociedade Anónima, share capital €50,000.00, registered with the Commercial Registry of the district of Leiria, operates www.lojadoouro.pt.

These terms apply to online consumer sales. Purchases are for persons legally capable of contracting; full legal capacity in Portugal is acquired at 18.

02Orders, contract and availability+

Before ordering, Customers can review products, quantities, price, discounts, delivery costs, billing, address and payment. The contract is concluded when an order carrying an obligation to pay is submitted and confirmed on a durable medium, notably by email.

Loja do Ouro may decline performance for unavailability, obvious error, reasonably suspected fraud, legal requirements or inability to validate payment. Amounts already charged are reimbursed where due. Operational/security limits may apply, currently up to 10 items and €5,000 per order unless otherwise stated or agreed.

03Jewellery, authenticity and product safety+

Precious-metal articles are sold under the Portuguese legal regime for goldsmithing and assay offices and, where applicable, carry legally required marks. Product pages state, where relevant, precious metal, fineness, precious-metal weight, gemmological materials, used condition, composition/coating and other required information.

Official hallmark exemptions depend on article and weight; official information includes certain exemptions for gold/platinum up to 0.5 g and silver up to 2 g, without prejudice to other marking duties. For products covered by Regulation (EU) 2023/988, required product/manufacturer identification, EU responsible person where applicable and safety information are displayed.

04Prices, investment gold, promotions and payment+

Prices are in euros and include applicable taxes unless stated otherwise. Delivery and other charges are shown before purchase. Prices influenced by precious-metal quotations may change until the order is completed; afterwards the agreed price applies, subject to obvious error or another lawful ground.

Products meeting the statutory definition of investment gold may qualify for the applicable VAT exemption. Price reductions follow applicable reference-price rules, including, where required, the lowest price in the previous 30 consecutive days. Payment methods are those shown at checkout; credit/instalment terms are set by the relevant provider.

05Dispatch, delivery and risk+

Online delivery times are estimates unless an essential date is expressly agreed. Orders may be sent by CTT Expresso and/or FedEx. Delivery costs, geographical restrictions and applicable customs information are shown before purchase or at checkout according to destination.

Risk passes when the consumer, or a nominated third party other than the carrier, takes physical possession, except where the consumer independently chooses a carrier not proposed by Loja do Ouro.

0614-day withdrawal and exceptions+

Subject to statutory exceptions, consumers have 14 days to withdraw from a distance contract without giving a reason. The period normally starts with physical possession; special rules apply to split deliveries, lots or parts. An unequivocal statement may be sent to apoiocliente@lojadoouro.pt.

No right exists in statutory cases including goods made to consumer specifications or clearly personalised. It may also be excluded for goods whose price depends on financial-market fluctuations beyond Loja do Ouro’s control that may occur during the withdrawal period, potentially relevant to certain investment-gold products.

This exception is not automatically applied to all jewellery. Where applicable, the absence of the right must be clearly disclosed before ordering, including on the product page and purchase flow.
07Returns, seals, refunds and exchanges+

Consumers may handle goods only as necessary to establish their nature, characteristics and functioning and may be liable for diminished value caused by excessive handling. An authenticity/tamper seal is a security measure: breaking it does not by itself extinguish a statutory withdrawal right where one exists, although it may be relevant to diminished value. Lack of original packaging alone does not remove statutory rights.

For a valid withdrawal, payments are reimbursed including the least expensive standard delivery offered. Refund is made within the statutory 14-day period, may be withheld until receipt or proof of dispatch, and uses the same payment method unless expressly agreed otherwise without cost. A commercial exchange policy may also apply, currently 15 working days, without restricting legal rights.

08Legal guarantee and lack of conformity+

For new goods, Loja do Ouro is liable for lack of conformity appearing within 3 years after delivery. A lack appearing in the first 2 years is presumed to have existed at delivery unless incompatible with the nature of the goods or defect.

Statutory remedies include repair or replacement and, where conditions are met, price reduction or termination. If lack of conformity appears within the first 30 days, immediate replacement or termination may be requested. For used movable goods, the period may be reduced by agreement to 18 months where permitted. Normal wear, accident, misuse or unauthorised intervention do not by themselves constitute seller-attributable lack of conformity.

09Security, fraud and data protection+

Additional checks and identification may be requested where required by law or proportionate and necessary to prevent fraud, money laundering, terrorist financing or identity theft. Processing may be suspended while a legally required check is pending.

Passwords, full banking authentication codes and card CVV are never requested by email, telephone or message. Personal data is processed under the GDPR, Portuguese Law 58/2019 and Loja do Ouro’s Privacy Policy.

10Complaints, disputes, applicable law and form+

Customers may use the contacts above and the Portuguese Electronic Complaints Book. For out-of-court disputes, the CNIACC (cniacc.pt) may in particular be competent, without prejudice to another competent ADR body. The former EU ODR platform was discontinued in 2025.

Portuguese law applies without depriving consumers in other countries of mandatory protections applicable where Loja do Ouro directs activities to that country. Mandatory consumer jurisdiction rules prevail. The applicable version is the one available when the contract is concluded.
